In the case of an impending divorce the child is not just being separated from one of his parents but from his grandparents as well. No matter what state you are in, family courts will try their hardest to keep the divorce from affecting the child as much as possible.
This includes allowing child visitation with their grandparents. Grandparents visitation rights can be granted during the time of an impending divorce, or afterwards, and written into legal settlements.
The courts will grant grandparent’s visitation if it is in the best interest of the grandchild. A family court wants to keep the child’s life as normal as possible, given the situations in a divorce, which includes continuous interaction with grandparents.
A grandparent may even in fact file for custody of a grandchild whose parents are divorcing. It is important to remember, though, that this type of grandparents custody is only given in times if the grandparents can prove that both parents are unfit.
To learn about how you apply for grandparents visitation during a divorce or even grandparents custody if both parents are unfit please go to The Custody Center where they have all the resources to explain these things even better than I can.
They are the best warehouse I have found for fighting for your grandparents rights and they have helped tons of grandparents in your situation. If anybody can help you, they can.
